This was completed by sending a notice of intent to suspend the license, and if the payer failed to respond, the Friend of the Court could secure an order suspending the payer's license.</span></p><p style="text-align: justify;"><span style="font-family: verdana;">MCL 552.628 has amended this process and changed the requirements for suspending a payer's driver's license.</span></p><p style="text-align: justify;"><span style="font-family: verdana;">Effective October 1, 2021, the Friend of the Court can only seek to suspend a driver's license if the following provisions are true:</span></p><div style="background-color: white; text-align: justify;"><span style="font-family: verdana;">(2) For a friend of the court case, a payer's driver license may be suspended if both of the circumstances in subsection (1) are true and both of the following additional circumstances are true:</span></div><div style="background-color: white; text-align: justify;"><span style="font-family: verdana;"> <span> </span><b></b>(a) The court has conducted an ability to pay assessment and determined that the payer has an ability to pay the support but is willfully not making his or her support payments.</span></div><div style="background-color: white; text-align: justify;"><span style="font-family: verdana;"> <b></b>(b) The office of the friend of the court determines that no other sanction would be effective in assuring regular payments on the support obligation and regular payments on the arrearage.</span></div><div style="background-color: white; text-align: justify;"><span style="font-family: verdana;"><br /></span></div><div style="background-color: white; text-align: justify;"><span style="font-family: verdana;">The Friend of the Court must assess each individual case to determine if there is another appropriate remedy to secure regular support before seeking to suspend a payer's driver's license. works in Michigan when one parent is paying child support to the
other. Many get confused that the cost is automatically broken down by
the percentages assigned to each party in the child support order, but
this is incorrect. If ordinary medical expenses are included in the
child support order, the payer (the parent paying the support) is
already contributing to the medical costs on a monthly basis as part of
the child support payment. Generally, this means that the payee (the
parent receiving the support) must cover the day-to-day costs. Only
once the total expenses <u>exceed</u> the stated annual ordinary medical
(AOM) threshold amount in the order (currently set at $454 per year,
per child), do the percentages kick in. This means that the payee
parent must be careful to keep track of the expenses along the way, <i>including keeping receipts</i>, so he/she can be ready when it is time to request
reimbursement from the payer parent.<br />
<br />
Once the payee parent exceeds the AOM amount, he/she has 28 days from
the date of the bill to request reimbursement from the payer parent. If
the payer fails to pay his/her portion of the bill, then the Friend of
the Court can enforce payment. In Wayne County, <a href="https://www.3rdcc.org/Documents/FamilyDomestic/FOC/InProPerMotions/FD-FOC%204045%20Complaint%20for%20Health%20Care%20Expenses%5E%5E%5E.pdf" target="_blank"><b>this form</b></a> must be filed to make a formal request. Again, it is necessary to show all receipts and accounting in order for the FOC to enforce the payment. <br />
<br />So what do ordinary medical expenses consist of, you ask? Usually they
include insurance co-pays and deductibles as well as most uninsured
medical costs for children. The term “medical” includes treatments,
services, equipment, medicines, preventative care, similar goods and
services associated with oral (including braces), visual,
psychological, medical, and other related care provided or prescribed
by a health care professional for the child(ren). Routine remedial care costs
(e.g. first aid supplies, cough syrup, and vitamins) do not qualify
as medical expenses.

However, more typically, parents share legal custody (joint legal custody) and in order to change the school of the child(ren), there either needs to be a) an agreement between the parties, or b) the court must hold an evidentiary hearing. </p><p>An evidentiary hearing to determine a change of schools is known as a <i>Lombardo </i>hearing, based upon the case of <i>Lombardo</i> v <i>Lombardo</i>, 202 Mich App 151 (1993). This case provides that the trial court must make an analysis of the school choice using the Best Interest Factors (MCL 722.23). This is far more than just a regular motion hearing, it is a trial-type of event where witnesses and exhibits are presented. School statistics are reviewed and considered by the court. Administrative Office moved all courts in the State to Phase 4 of their

directives that all Court’s comply with local county health department
directives and MIOSHA requirements. MIOSHA, in turn, removed the
majority of its mandatory restrictions as well. The Michigan Supreme Court recently enacted Michigan Court Rule 3.223 allowing parties to file for divorce jointly. Rather than filing as the traditional Plaintiff v Defendant, the Supreme Court created a new process allowing parties to file a Joint Petition in the matter of Party A and Party B. This new action streamlines the process for people who are looking to separate amicably, choose to engage in pre-filing mediation and have executed a Consent Judgment of Divorce resolving all outstanding issues. After execution of the Judgment, the parties file the Petition to ask the Court to enter the Judgment after the 60-day waiting period expires and the Court will set a hearing date.<br />

In a divorce with minor children, the statutory waiting period is increased to 6 months. A Judge cannot enter a Judgment for 6 months from the date of filing of the Petition unless the parties demonstrate unusual hardship or such compelling necessity convincing the Court to waive the waiting period. MCL 552.9f. The Petition form allows the parties to state why the Judge should waive the 6-month waiting period and enter the Judgment of Divorce after 60 days. Each individual Judge has different criteria regarding a waiver of the 6-month waiting period and a waiver will vary greatly depending on each family's situation.<br />

1. Join the Zoom Hearing. All parties should do the following to join your hearing at the time of the call:<br />

4. The Judicial Assistant will bring you “into” the virtual hearing at or around the designated time. Before speaking, please wait until your line is unmuted by the Court.<br />

court order provides, parents should cooperate with each other to further the
child’s best interests. If parents are not able to agree between themselves how
to do this, their court order continues to control what they should do.”<o:p></o:p></span></div>

Avoid making careless comments in front of the children and exposing them to endless media coverage intended for adults. Don’t leave the news on 24/7, for instance. But, at the same time, encourage your children to ask questions and express their concerns and answer them truthfully at a level that is age-appropriate.</span></div>

The custody agreement or court order exists to prevent endless haggling over the details of timesharing. In some jurisdictions there are even standing orders mandating that, if schools are closed, custody agreements should remain in force as though school were still in session.</span></div>

<span style="font-family: "verdana" , sans-serif;">At the same time, it would be foolish to expect that nothing will change when people are being advised not to fly and vacation attractions such as amusement parks, museums and entertainment venues are closing all over the US and the world. In addition, some parents will have to work extra hours to help deal with the crisis and other parents may be out of work or working reduced hours for a time. Plans will inevitably have to change. Encourage closeness with the parent who is not going to see the child through shared books, movies, games and FaceTime or Skype.</span></div>

Certainly both parents should be informed at once if the child is exhibiting any possible symptoms of the virus.</span></div>

The parent who is paying should try to provide something, even if it can’t be the full amount. The parent who is receiving payments should try to be accommodating under these challenging and temporary circumstances.</span></div>

<span style="font-family: "verdana" , sans-serif;">Adversity can become an opportunity for parents to come together and focus on what is best for the child. For many children, the strange days of the pandemic will leave vivid memories. It’s important for every child to know and remember that both parents did everything they could to explain what was happening and to keep their child safe.</span></div>

The Michigan Court of Appeals recently released an unpublished decision ordering the division of lottery winnings won while the parties were separated, but not yet divorced.</div>

<a href="http://publicdocs.courts.mi.gov/opinions/final/coa/20190613_c342854_36_342854.opn.pdf" target="_blank">Zelasko v Zelasko, COA 342854</a>, is a high-stakes divorce action that has found itself at the Court of Appeals twice. The parties were in the middle of arbitration with an arbitrator who became ill and passed away, which caused multiple issues requiring appellate review.</div>

Mr. Zelasko purchased a lottery ticket while the parties were separated for 5 years and after the arbitration hearing had been completed, but before the arbitration award had been rendered, and won $80M. Prior to winning the lottery, Mr. Zelasko worked in a t-shirt shop. The arbitrator ordered Mr. Zelasko to divide his winnings as they are considered marital property. The arbitrator reasoned that the $1 spent to purchase the lottery ticket was marital money and any loss or gain earned should be considered part of the marital estate.</div>

The Court of Appeals affirmed the arbitrator's award, and pursuant to Byington v Byington, 224 Mich App 103; 568 NW2d 141 (1997), awarded Ms. Zelasko $15M of the lottery winnings. “The goal of the court when apportioning a marital estate is to reach an equitable division in light of all the circumstances.” Byington, 224 Mich App at 114.</div>

Almost 20% of those surveyed said that hiding a bank account or credit card, especially when it comes to overspending, is akin to physical infidelity. </span></span><br />
